The conditions we discussed in Part 1 and Part 2, there are some marks which have been classified as a prohibited mark and cannot be registered. The list of Prohibited mark can be access by https://ipindiaonline.gov.in/tmrpublicsearch/prohibitedmarks.aspx.
In the mentioned list, one mark which we see most of the businesses apply for and use is “BALAJI” which is a Prohibited Mark.
Even the Gujarat one of the renowned wafer making company Balaji Wafers private Limited has applied numerous Trademark application with the mark “BALAJI” but unfortunately did not get the exclusive right on the word BALAJI, even though they are claiming to use the same since 1986.
It is advisable that one should not apply for the word and names mentioned in the aforesaid list for the Trademark Registration.
